Voluntary Dismissal With Prejudice of an Assignment-Of-Benefits Case

Sarah Goldberg, of our Miami office, obtained a Voluntary Dismissal with Prejudice of an assignment-of-benefits case that had been litigated for over two years. Plaintiff was seeking additional payment for invoices appraised pre-suit. The summary judgment hearing was cancelled twice due to COVID-19 issues. Plaintiff could not delay any further when the Judge smartly requested an in-person appearance for the hearing and required the caselaw supporting Plaintiff’s position to be provided over the weekend prior to the hearing. Plaintiff folded and filed a Voluntary Dismissal the night before the hearing.
