Voluntary Dismissal with Prejudice in Personal Injury Protection / Fraud Case

Eric Tourian, of the Orlando office, received a dismissal in a case involving a motor vehicle accident in which the Insured allegedly suffered injuries. Following the accident, the Insured sought treatment from a medical provider, who submitted its bills to the carrier. The medical provider alleged that the carrier did not properly reimburse it for its medical bills and thereafter filed suit as an assignee of the Insured, based on her no fault/personal injury protection auto insurance benefits.

In this case, Eric was able to determine the owners of the Plaintiff clinic were all arrested and indicted on charges of insurance fraud. One of the three owners had already pled guilty and was serving a prison sentence. The other two owners are awaiting trial in Jacksonville.

Eric brought these facts to the attention of the Plaintiff’s attorney, who in turn, dismissed the case with prejudice.
