Nicole Wulwick from our Miami office, was successful on a Motion for Summary Final Judgment in a hotly contested case involving hail property damage in Orange County. The carrier provided coverage for damages and Plaintiff replaced the roof before the lawsuit was filed. However, Plaintiff never submitted any damages estimate to the carrier to contest the pre-suit payment before the lawsuit was filed. During litigation, the public adjuster finally provided the carrier with a replacement cost value damages estimate although the property had already been sold to another owner.
Nicole moved for Summary Final Judgment, arguing that Plaintiff failed to establish any breach of contract because no damages estimate was provided to contest the carrier’s pre-suit payment. The Court issued a very detailed order in favor of Nicole’s arguments, one of the first in Orange County. This matter carried substantial exposure for the carrier. Nicole’s strategic approach and persuasive advocacy were key in obtaining this favorable outcome.
