Strong Defense Result in First-Party Property Trial in Monroe County

Stephanie Suarez and Karla Lockwood of our Miami office secured an excellent result in a challenging first-party property insurance trial in Monroe County.

Plaintiffs alleged significant roof and interior damage from a purported storm event and sought to attribute the loss to a new date of damage. Stephanie and Karla successfully demonstrated that much of the claimed damage was consistent with and pre-existed the alleged storm, including similarities to a prior Hurricane Irma claim.

Despite plaintiffs seeking a substantial award at trial and making a significant pre-trial demand, the jury returned only a minimal verdict.

Importantly, the limited verdict did not trigger the plaintiffs’ Proposal for Settlement, preventing any entitlement to attorney’s fees in this post–tort reform matter — a critical outcome for the carrier.

This was a difficult case with meaningful exposure, and the result reflects strong preparation, strategic focus, and effective advocacy.
