Professional Liability

Our experience and reputation gives us an edge in recommending the best litigation strategy. When the claim has merit and should be resolved, we do so as quickly and efficiently as possible. Claims that lack merit are defended vigorously.

In addition to defending malpractice claims when they arise, we are committed to helping professionals and their associated professional liability insurance carriers recognize and correct areas of their practices that create litigation exposure. We provide risk management services to all of our professional clients and are frequent lecturers at continuing education seminars across the nation.

Architects and Engineers Our attorneys defend architects, engineers, and other design professionals involved in liability claims arising from vertical construction, road and bridge design, utilities and other infrastructure related projects throughout the State of Florida.

Directors and Officers We defend corporate directors and officers in all types of liabilities claims. In the defense of these claims, which range from embezzlement to employment practices, we draw on our extensive expertise in the underlying areas of securities laws, banking, complex commercial litigation and employment law.

Attorneys Few areas of professional liability offer as many challenges as does attorney malpractice. The defense of attorneys requires an ability to quickly understand the often-complex matters that are the source of legal malpractice claims, as well as an appreciation for the sensitive nature of the attorney-client relationship. Drawing on our extensive professional malpractice defense experience, we are frequently able to resolve claims without the later stages of litigation.

Accountants Accountant malpractice lawsuits differ in a number of important ways from medical or legal malpractice lawsuits:

  • Adherence to GAAP and the GAAS is a powerful defense
  • Many accountant malpractice cases are based on violations of federal and state statutes relating to the sale of securities.

At Kubicki Draper, we utilize our expertise in finance, securities and tax practice to successfully defend accountants against charges of professional malpractice and to advise them of their responsibilities and potential liabilities.

Realtors Although the great majority of professional malpractice actions are filed against medical providers and attorneys, in an area like South Florida, where the real estate market is particularly dynamic, the incidence of realtor malpractice claims is significant. We have been providing real estate litigation and transaction services as well as professional liability defense for many years. Combining the expertise of our real estate attorneys and our defense litigators results in our ability to provide the best defense for our clients.

Veterinarians The firm advises veterinarians on potential claims, and represents veterinarians in matters brought by the Department of Professional Responsibility, Board of Veterinary Medicine, challenging a veterinarians action or inaction and threatening his or her licensure. Having attorney representation from the first notice of such an action allows for the controlled flow of information, prohibits waiver of defenses or inadvertent admissions and helps to ease the stress and uncertainty created by having such a claim made to one’s license.
