Administrative Law and Criminal Licensing

A driver cited for a non-criminal traffic infraction for excessive speed or for a crash that causes death or serious bodily injury to another must appear before a Judge for a civil traffic court hearing. In such hearings, the court will often question the cited driver as well as other witnesses in order to determine if an infraction was committed. If the cited driver ultimately pleads “guilty” to the traffic citation or otherwise gives testimony at the hearing, the fact of the plea and/or the words of the testimony can be used against the cited driver in a later personal injury lawsuit. It is imperative that cited drivers have aggressive legal representation at such civil traffic ticket hearings in order to “get out in front” of any potential personal injury lawsuits that may eventually be filed. Our attorneys are particularly skilled in defending drivers required to appear for civil traffic court hearings and will either work to have the ticket dismissed or otherwise achieve a resolution to the matter with the goal of limiting any unfavorable testimony or pleas that could later be introduced as evidence of negligence in a later personal injury lawsuit.
