On May 25, 2023, the Governor signed into law Florida Senate Bill 1002 Motor Vehicle Glass. Most substantially, the law:
1. Makes it unlawful for a motor vehicle repair shop to offer a customer any gift or inducement in exchange for making an insurance claim for auto glass replacement or repair, including calibration or recalibration of “Advanced Driver Assistance Systems” (ADAS).
2. Prohibits individuals from entering into an AOB for auto glass repair or replacement under an auto insurance policy issued or renewed on or after July 1, 2023. Any assignments entered into in violation of this provision are void and unenforceable.
3. Prohibits insurance companies from requiring a claimant to use a particular company or location for the auto glass repair, replacement, or recalibration.
4. However, an insurer can offer a policy with a repair arrangement, in which event the insurer is required to provide “an actuarially sound discount” to the insured.
5. Additionally, the calibration and recalibration of “Advanced Driver Assistance Systems” (ADAS) are now explicitly defined and included in the Florida Motor Vehicle Repair Act.
