Jury Returns Verdict Well Below Plaintiff’s Damages Request in Auto Accident Case

Jason Friedman, of our Fort Lauderdale office, and Jared Brownfield, of our Tallahassee office, secured a favorable jury verdict in a motor vehicle accident case involving significant claimed damages.

Prior to trial, the plaintiff’s lowest settlement demand was $550,000, through a Proposal for Settlement. While the jury was deliberating, Plaintiff increased the demand to $600,000.

At trial, the plaintiff presented testimony from a life care planner who projected approximately $1.2 million in future medical expenses, as well as testimony from multiple treating providers who opined that the plaintiff sustained permanent injuries as a result of the accident. In closing argument, the jury was asked to award approximately $2.6 million in damages.

The defense focused on challenging the credibility of the plaintiff’s claims and the factual foundation underlying several of the medical opinions offered at trial. Through cross-examination, the defense established evidence that called into question the accuracy of the information relied upon by certain treating providers in forming their opinions regarding causation and permanency.

Following deliberations that extended into a second day, the jury returned a verdict of $125,000, consisting of future medical expenses and past and future pain and suffering — substantially less than the damages sought.

The result reflects the team’s thorough preparation, strategic presentation of the evidence, and effective advocacy throughout the proceedings.
