Florida General Contractors Will Soon Have a Statutory Right to Recovery of Attorney Fees Against a Defaulted Subcontractor's Surety

For decades, the Florida Statute by which legal fees may be recovered, provided this right to owners, subcontractors, laborers and materialmen, but did not include contractors. Historically, contractors could only pursue fees where provided for in a bond or under certain circumstances. Effective October 1, 2019, the new version of Florida Statutes § 627.756(1) adds contractors, giving them the right to recover attorney fees incurred in asserting claims against a surety when a subcontractor defaults.
