Dismissal Secured in Products Liability Case for Lack of Personal Jurisdiction

Stephen Cozart and Cristina Federico, from our Pensacola office, obtained a dismissal in a products liability case based on lack of personal jurisdiction.

The firm’s client, a Canadian manufacturer of automotive parts for classic cars, was sued after one of its parts allegedly malfunctioned and caused the plaintiff’s vehicle to catch fire. The parts are distributed through various independent retailers across the United States.

Steve and Cristina developed compelling evidence and argument demonstrating that the client had not purposefully availed itself of Florida’s jurisdiction. Following a hearing, the court agreed, ruling that the Canadian client was not subject to jurisdiction in Florida and dismissed the case.
