Defense Verdict: Rear-End Collision with Disputed Liability Defeated at Trial

Jeremy Chevres, of our Ft. Myers office, secured a complete defense verdict in a rear-end collision case involving disputed liability. Our clients—the driver and owner of a landscaping company—were sued after the driver, operating a company work truck and towing a trailer full of equipment, collided with the Plaintiff, who had stopped abruptly for a yellow light.

Jeremy successfully defeated Plaintiff’s Motion for Directed Verdict on the Rebuttable Presumption applicable to rear-end accidents. Jeremy also prevailed on his own Motion for Directed Verdict, arguing there was no record evidence to support a jury instruction on aggravation of injuries.

After just 50 minutes of deliberation, the jury returned a defense verdict, answering “no” to the only question they needed: whether the negligence of our client was a legal cause of Plaintiff’s injuries.
