Defense Verdict In Charlotte County Sideswipe Accident

Stefanie Capps and David Frantz received a verdict of no injury caused in a sideswipe accident in Charlotte County. The plaintiff, a 45-year-old doctor in Jacksonville, claimed he suffered injuries to his neck and back as a result of the crash and that the pain made it difficult to practice medicine.

A four-day trial ensued in front of Judge Gentile. The plaintiff agreed to a directed verdict on future medical bills and proceeded only on permanence and causation, asking the jury for $1.5 million. Stefanie performed an extremely effective cross-examination of the plaintiff and presented expert testimony establishing that the forces involved in the crash were not significant enough to cause any injury, let alone the herniated discs claimed by the plaintiff.

The jury agreed, deliberating for 90 minutes before delivering a full defense verdict.
