Defense Prevails in Commercial Trucking Trial

 

 

Philip Wiseberg and David Drahos of our West Palm Beach office secured a defense verdict in a commercial trucking case. The jury rendered its decision in just 19 minutes!

Our client was traveling at 77 mph on a rainy I 95 when the Plaintiff—driving with bald tires and traction control off—lost control. In an attempt to avoid a collision while hauling a load from North Carolina, our client moved into the far left lane. However, the Plaintiff’s vehicle slid into that lane, causing a severe t bone collision.

Despite the Plaintiff’s expert simulation claiming our client should have braked, Phil’s rigorous cross-examination discredited this argument. With the support of Sharon Degnan on our appellate team, David and Phil obtained a directed verdict dismissing the Plaintiff’s claims for future medical expenses. Notably, a $50,000 settlement proposal filed in October 2023 was rejected.
