Stefanie Capps and Emily Huang, of our Ft. Myers office, obtained a complete defense verdict in Lee County in a rear-end accident case with admitted liability.
Although liability was not contested, the case centered on causation and damages. The Plaintiff, a young man who had undergone knee surgery prior to trial and was scheduled for another procedure, repeatedly misrepresented both the severity of the accident and his own medical history throughout litigation.
The Plaintiff consistently told his treating physicians that the collision occurred at a high rate of speed. However, he apparently did not anticipate that trial would include video evidence showing our insured was traveling less than 5 miles per hour at the time of impact — a minimal bump to the rear bumper. Even after viewing the video at trial, the Plaintiff doubled down on his account, claiming that our insured’s vehicle ended up “on top” of his.
Emily methodically and effectively impeached the Plaintiff on the numerous inconsistencies in his testimony. Their team also uncovered records that directly contradicted the Plaintiff’s attorney’s claim that he had no prior history of back, neck, or knee pain before the accident.
