Class Actions / Multi-District Defense
Class action litigation is a specialized area of the law where, oftentimes, the primary defense strategy is to defeat class certification. Multidistrict Litigation (MDL) refers to a special federal legal procedure designed to speed the process of handling complex cases in federal court when civil actions involving one or more common questions of fact are pending in different districts. Cases consolidated under MDL typically involve hundreds (or thousands) of plaintiffs in dozens of different federal courts that all share common issues. Kubicki Draper has attorneys who have successfully handled a wide range of class action and MDL cases, including cases involving products liability, pharmaceuticals, environmental contamination, and Telephone Consumer Protection Act (TCPA) violations. Specific recent representations include obtaining a dismissal on behalf of two automobile insurers sued for alleged antitrust violations in the well publicized “body shop” MDL litigation; representing several clients in asbestos, silica and Chinese Drywall MDL litigation; obtaining a denial of class certification in a multimillion dollar products liability defect case brought against the manufacturer of septic tanks (now a published opinion on Westlaw) and successful representations (and resolutions) of several TCPA class action claims involving claims of “fax blasting”.
