11th Circuit Holds No Liability in Spider Bite Case

Caryn Bellus, of our Miami office, prevailed on all issues on appeal in a premises liability case. In Hruska v. On the Edge Dockside LLC, d/b/a On The Edge Bar and Grill, 2022 WL 1284253 (11th Cir. April 29, 2022), Plaintiff sued a restaurant and individual members of an LLC for negligence claiming that she was bitten by a spider while dining in the restaurant’s outdoor dining area. In its opinion, the Eleventh Circuit declined Plaintiff’s appeal of a Magistrate’s discovery order. The Court then affirmed the trial court’s dismissal of Plaintiff’s claims against the LLC’s individual members, finding that Plaintiff failed to pierce the corporate veil. After reviewing the legal duties a landowner owes to a business invitee and the evidence regarding maintenance of the restaurant, the Court also affirmed summary judgment in favor of the restaurant finding that there was no evidence that the restaurant breached its duty to maintain the premises in a reasonably safe condition.
